1. General Principles

1.1 On the Site www.brutusfactory.com it is possible to purchase products made by Brutus Srls such as clothing, footwear, accessories, furnishings and design objects, whose technical characteristics are shown in the catalogue on the Site, according to the following Conditions of Sale.

1.2 The terms and conditions indicated here apply to all purchase orders placed in Italy and other countries in the European Union and are an integral part of the sales without the need for express reference. The conditions of sale do not apply to purchases made in the UK.

1.3 The Customer can purchase only the products listed and viewable in the online catalogue at the time the order is placed.

1.4 Brutus reserves the right to modify the characteristics and/or technical specifications of its Products or the prices applied to them.

1.4 These Conditions of Sale may be modified by Brutus at any time. For each purchase, the contractual terms in place at the time the order is concluded will apply, therefore the Customer is invited to check for any revisions.

2. How to purchase

2.1 It is possible to purchase Brutus products using one of the following methods:


To proceed with the online purchase, the Customer must fill in the Purchase Form on the Site.

The purchase order will be considered complete only after the Customer has accepted the Conditions of Sale using the "Confirm Order" button on the Purchase Form. Once the order has been received, Brutus will send an order confirmation e-mail to the address indicated by the Customer, thus confirming a contract has been entered into between Brutus and the Customer. 

At the end of the aforementioned online purchase procedure, the Customer must print or save or otherwise keep a copy of these general conditions of sale, in compliance with the provisions of Legislative Decree 206/05 (consumer code).


To place a telephone order, call +39 331-1365856 Monday to Friday, 9:30 am - 1:00 pm and 2:00 pm - 5:00 pm (GMT+1).

Brutus will assist the Customer in all phases in defining the order, providing information on products and giving advice with maximum efficiency and availability.


To place an order by e-mail, you need to download the appropriate form from the Site, fill in all required fields and email it to customer.care@brutusfactory.com.

Once the aforementioned form has been received, Brutus will process the order and notify the Customer of the acceptance by sending confirmation to the e-mail address indicated by the Customer.

It should be noted that ordering online is the only accepted method for purchasing items that are specially sized (outside the normal size range), custom-made or designed ad hoc.

2.2 Each order will be accompanied by a regular Packing List or Commercial Invoice (only if specifically requested at the time of the order in the notes section).

3. Shipping methods and times

3.1 Brutus delivers its products throughout the Italian territory and in all European Union countries (Austria, Belgium, Bulgaria, Croatia, Czech Republic, Denmark, Estonia, Finland, France, Germany, Greece, Hungary, Ireland, Latvia, Lithuania, Luxembourg, Holland, Principality of Monaco, Poland, Portugal, Romania, Slovakia, Slovenia, Spain, Sweden).

3.2 Product shipments will be made by DHL Express Courier. The package may be tracked by clicking on the link sent by e-mail when the order is finalised.

The Courier delivers within Italy in approximately 24-48 hours (48 hours for Puglia, Basilicata, Calabria and the Islands) from Monday to Friday.

3.3 Orders will be processed as soon as possible and the products will be shipped within the terms indicated in the product sheet, any delays will be promptly communicated to the Customer.

3.4 With regard to specially sized, custom-made or "Design" items, the terms of production and delivery will be communicated to the Customer during the order confirmation.

3.5 Upon receipt of the goods, the Customer must check:

 - that the packaging is intact, undamaged, not wet or otherwise altered;

 - that the number of packages delivered corresponds to what is indicated in the waybill.

In case of damage or tampering with the packaging or non-correspondence with what is indicated in the waybill, the Customer must immediately submit the matter to the carrier and, alternatively, (i) reject the goods by returning them to the carrier or (ii) accept them with right of reserve, making clear the non-conformity found. In the latter case, it will be possible to request compensation for damage suffered by the product found following the opening of the package.

In the event that no packaging anomalies are reported at the time of delivery, the goods will be considered delivered correctly and accepted, resulting in the release of Brutus from any liability for packaging defects or discrepancies with respect to the order.

3.6 Brutus will not be responsible for failure or delay in delivery due to causes of force majeure not attributable to these such as, by way of example and not an exhaustive list: strikes, provisions of the Public Authority, transport difficulties, fires, floods, earthquakes, floods, wars, uprisings. Brutus will promptly notify the Customer of the occurrence of a cause of force majeure.

4. Shipping costs

For all purchases made in Italy with an amount exceeding € 50 or in case of payment by cash on delivery, shipping will be free.

For purchases made in Italy for an amount of less than € 50 or those purchased from abroad, the shipping costs will be charged to the Customer and will be expressly indicated at the time of order confirmation.

5. Prices and payment methods

5.1 Regarding the purchases made in Italy, the prices indicated in the corresponding price list include VAT and transport costs.
Regarding the foreign purchases, the transport costs, expressly indicated for each country, will be charged in addition to the price list.
Possible discounts or offers will be applied net to the price list without including the transport costs.

5.2 All prices indicated in the price list are inclusive of Value Added Tax (known as IVA in Italy), inclusive of transport costs and any discounts related to the Customer's promotional codes.

5.3 The payment of the products can be made in the following ways:

• Cash on delivery: the customer must pay the sum due directly to the courier upon receipt of the goods. The Courier does not accept cheques therefore payment must be made in cash.

• Credit Cards: for payment by credit card, Brutus uses the Stripe direct payment gateway with which it is not necessary to create an account to proceed with the payment. Credit card transactions are carried out guaranteeing maximum security in SSL (Secure Socket Layer) mode.

• Paypal: in the event that the Customer chooses to pay with Paypal, they will be redirected to the relevant secure Paypal page where they must enter their e-mail address and registered password and proceed with the payment.

• Bank transfer: payment must be made within 7 working days of order confirmation to the following bank details: Brutus Srls - Banca d 'Alba - IBAN code: IT53X0853001000000260110110, indicating the reference to the purchase order.

Payment by bank transfer postpones the execution of the contract until the time the Seller's current account is credited.

This is the only payment method accepted for the purchase of specially sized or custom-made items.

6. Products specially sized, custom-made or designed ad hoc

6.1 For the purchase of specially sized or custom-made products or items designed according to the Customer's requests, the following conditions apply.

6.2 Purchase orders for these products can only be made online and their price will be defined during the product definition process. Brutus will inform the customer about the possibility of fulfilling the order of the requested products by sending the order confirmation by e-mail.

6.3 The production and delivery times for specially sized or custom-made products will be communicated by Brutus following receipt of the order.

6.4 The only method of payment accepted for the purchase of these products is by bank transfer.

6.5 The provisions referred to in point 8 do not apply; notably that the customer cannot withdraw from the contract and the products cannot be returned.

7. Customer Service

Brutus offers its customers Service Assistance in order to provide all necessary information about its products and to guarantee support during the purchase phase and post sale.

The service is active from Monday to Friday, 9:30 am to 1:00 pm and 2:00 pm to 5:00 pm (GMT+1).

8. Right of withdrawal and return procedures

8.1 Following the purchase of Brutus products - with the exception of specially sized, custom-made or ad hoc designed products - the Customer may exercise the right of withdrawal in the following ways.

The return request must be sent to Brutus within 14 days of receipt of the products, as per the procedure referred to in point 8.5, specifying the bank details to which the refund must be made.

8.2 In order to be returned, the product must not have been used in any way, must not have any signs of damage or tampering and must be complete with labels and/or tags intact. Otherwise, the return request will not be accepted and the products will be sent back to the Customer and any costs incurred will be at the Customer’s expense.

8.3 For the return of the product, the same packaging with which the item was shipped may be used, or any packaging with the appropriate dimensions and protection to prevent damage during transport.

8.4 Brutus applies the "Free Return" solution for all orders placed in Italy. In case of return of products sold abroad, 

the shipping costs will be charged to the customer.

8.5 In order to make the return, the following procedure must be followed:

    if the Customer is registered

- access your Personal Area;

- once you have entered the Personal Area, select the item to be returned in "My Orders" and click on the "Return" button;

- fill in the mandatory fields and select the type of return;

- submit the return request by clicking "Submit your return request". The customer will receive an e-mail with instructions on how to properly ship the package.

    If the Customer is not registered because the purchase was made without logging in:

- access "__________________";

- fill in the required fields and click on the "Continue" button;

- submit the return request by clicking "Submit your return request".

8.6 Within 14 working days from receipt of the returned product and after verifying its integrity, Brutus will make the refund using the same method used for payment of the order, except for cash on delivery which will be refunded by bank transfer.

Actual reimbursement times may vary according to the contractual conditions applied by the various credit card or current account service providers used.

In the event of a refund request for a product that is part of an order that was subject to a special promotion (such as the application of a discount on reaching a spending threshold), the value of the refunded portion will be subject to the recalculation of the promotion on the items of the same order that were not returned.

9. Product Warranty

9.1 All products sold by Brutus are guaranteed against flaws, defects or non-conformities for 24 months.

The 24-month warranty pursuant to Legislative Decree no.24 of February 2, 2002 is reserved for private consumers (a physical person who purchases the goods for purposes not related to their professional activity, or makes the purchase without indicating a VAT number in the Purchase Form). In the case of purchases for professional activity with an invoice request (with VAT number), the guarantee is valid for 12 months.

9.2 To activate the product warranty, the Customer must report the existence of defects within the deadline by sending an e-mail to customer.care@brutusfactory.com, attaching photographs and a description of the non-conformity found.

9.3 In case of defects or non-conformities, Brutus will, where possible, restore the conformity of the product by repairing or replacing it.

9.4 The shipping costs for returning the goods under warranty will be charged to the Customer if the request is forwarded to Brutus after 30 days from receipt of the products.

9.5 By subscribing to the Brutus Wild Card the purchased products will be guaranteed against conformity defects for a "lifetime".

10. Privacy

10.1 The Customer authorises Brutus to process their personal data for the sole purposes referred to in these General Conditions of Sale.

10.2 The processing, storage and transmission of personal data will be carried out by adopting all necessary measures to guarantee their security and confidentiality, in compliance with the provisions of current legislation on the subject, for the sole purpose of being able to effectively fulfil the obligations established by statutory, civil and fiscal regulations related to the company's economic activity.

11. Applicable law - Jurisdiction

11.1 These Conditions of Sale are governed by Italian law. For anything not expressly indicated in the aforementioned conditions of sale, the provisions of the current legislation on the subject apply.

11.2 In the event of disputes arising from this contract or related to it, the parties undertake to seek a fair and amicable settlement.

In case of failure to reach the aforementioned resolution, it will be undertaken exclusively in the Turin jurisdiction.
